Terms of Service

These Terms of Service apply to your use of the Innovision Labs website, AI Studio, creator dashboard and related services, provided by Innovision Labs, an Australian business (“we”, “us”, “our”). By creating an account or using our services you agree to these terms.

Our Privacy Policy explains how we handle your personal information.

You must provide accurate information when you sign up and keep it up to date. You are responsible for keeping your password secure and for all activity on your account. Tell us promptly if you believe your account has been accessed without permission.

You must be at least 18 years old, or have the consent of a parent or guardian, to create an account.

You agree not to use our services to: break any law; infringe anyone else’s intellectual property or privacy; upload or generate content that is unlawful, harmful, defamatory, abusive or misleading; attempt to gain unauthorised access to our systems or other users’ accounts; interfere with or disrupt the services; scrape, resell or reverse-engineer the services; or use automated means to access the services beyond what we offer.

We may remove content or suspend access where we reasonably believe these terms have been breached.

Spark is free. Studio Pro costs A$19 per month and Studio Max costs A$49 per month. All prices are in Australian dollars and include GST.

Paid plans are billed monthly in advance through our payment provider, Stripe, and renew automatically each month until cancelled.

You can cancel at any time through Manage billing in your account. When you cancel, you keep access to your paid plan until the end of the period you have already paid for, and you will not be charged again.

We may change our prices. We will give you reasonable notice before a price change applies to your subscription, and you can cancel before it takes effect.

Refunds are handled in line with our Refund Policy. Our services come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these terms limits those rights.

Prototype requests are available to Studio Pro and Studio Max members. If we agree to develop your idea into a product, you choose one of three funding tiers. Creator-funded: you fund the prototype and receive 50% of net profit. Co-funded: we share the costs and you receive 40% of net profit. Company-funded: we fund the prototype and you receive 25% of net profit.

Net profit means revenue from sales of the product, minus GST and the manufacturing, fulfilment, platform and marketing costs.

Before net profit is shared, each side recovers the project costs it paid for, in proportion to what it contributed. Innovision Labs always keeps a minimum margin of 15% of net profit.

As part of the prototype process you sign a non-disclosure agreement (NDA) together with the Development Agreement, both signed offline and governed by Western Australian law, before any design work starts.

Each project is governed by a separate Development Agreement signed by you and us. If that agreement differs from this summary, the signed agreement applies. Revenue figures shown in the app are estimates only.

As between you and us, you own the ideas you submit and the outputs AI Studio generates for you, subject to any rights of third parties.

You are responsible for how you use outputs, including checking that they are suitable for your purpose and do not infringe anyone else’s rights before you rely on, publish or commercialise them.

AI outputs are generated automatically and may be inaccurate, incomplete or similar to content generated for others. They are not professional legal, financial, engineering or patent advice.

You give us a limited licence to host, process and display your content only as needed to provide and improve the services to you.

The Innovision Labs name, logo, website, software, designs and other materials we provide (excluding your content and outputs) are owned by us or our licensors. You may not copy, modify or use them except as needed to use the services in line with these terms.

We are continually improving our services and may add, change or remove features. If we make a change that significantly reduces a paid feature, we will let you know.

We aim to keep the services available at all times, but they may occasionally be unavailable due to maintenance, updates or events outside our control. We do not guarantee uninterrupted or error-free service.

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

To the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data or opportunity, arising from your use of the services. Where our liability for failure to comply with a consumer guarantee can be limited, it is limited (at our option) to supplying the services again or paying the cost of having them supplied again.

You can stop using the services and ask us to close your account at any time.

We may suspend or close your account if you seriously or repeatedly breach these terms, if required by law, or if we stop offering the services. Where reasonable, we will give you notice first. If we close your account without cause, we will refund any unused portion of fees you have paid in advance.

These Terms are governed by the laws of Western Australia, and you submit to the non-exclusive jurisdiction of the courts of Western Australia.

We may update these terms from time to time. We will publish the updated terms on this page with a new “last updated” date and, for significant changes, notify you by email or in the app. Continuing to use the services after changes take effect means you accept the updated terms.
